Terms and Conditions (GTC)
BASIC PROVISIONS ACCORDING TO §1
The following general terms and conditions govern all purchase contracts between the provider, B & C Grossrubatscher Onlineshop GbR (Grödner Holzschnitzerei Gebr. Grossrubatscher), office Veitingergasse 20, 1130 Vienna, Austria, and the customer. Unless otherwise agreed, the inclusion of your own conditions is contradicted.
CONTRACT LANGUAGE/CONCLUSION OF CONTRACT
German is agreed as the contract language. Communication with the customer is also possible in English, French or Italian.
We only conclude contracts with customers who are of legal age and have legal capacity.
CONDITION OF GOODS
Slight color deviations of our wood carvings from the images are possible and are a sign of handcraft. The grain of natural figures can also vary.
INDIVIDUAL ORDERS
Due to the high degree of individuality in relation to the customers' personal ideas, as well as the transmission of the templates (photos, sketches, etc.), there may be deviations from the customer's most personal ideas, which to a certain extent also affect the can be attributed to the natural limitations of the wood texture as well as the artistic freedom of the artist. In coordination with the customer, who also has to define the templates as well as the personal ideas and specifics as well as the size as clearly as possible, the specifications are coordinated and defined with the offer. Differences in taste that can be perceived purely subjectively, but cannot be clearly identified from the photos and sketches etc., do not lead to any claims or a refund of the price paid. Likewise, deviations from the specifications that arise due to the natural nature of the material or due to the pure handwork (for example exact millimeter specifications or angle of inclination) do not lead to a claim for a refund of the purchase price. The customer pays for the working time of the artist referred to, as well as for the entire work. There is no entitlement to a photo-exact copy of the specifications. B & C Grossrubatscher Onlineshop GmbH is the dealer and intermediary for sculptors/carvers and coordinates the orders that are produced by carving companies in Val Gardena and the surrounding area. We always strive to achieve the best possible end result for the customer, based on our trust in the enormous artistic skills of the Val Gardena carvers.
PRICES
For orders in our online shop, the prices listed in the offer at the time of the order apply. The prices listed are the final prices including sales tax. All prices are per piece and can be found in the online shop or catalogs.
The prices for individual orders (individual pieces, restoration, individual design) are agreed directly with the customer depending on the order. Cost estimates will be sent, which the customer can accept bindingly. This must be done in writing, by email.
Unless otherwise agreed, individual orders must be transferred in advance (the entire order amount), after which the order is considered binding. Any remaining amount can be paid in cash after completion of the order, in the event of personal delivery or collection or by bank transfer before shipping. The object of the order remains the property of B & C Grossrubatscher Onlineshop GbR (Grödner Holzschnitzerei Gebr. Grossrubatscher) until the payment amount has been paid in full.
WARRANTY
The legal regulations apply.
The customer undertakes to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to report any complaints to the provider and the freight forwarder as quickly as possible. If the customer does not comply with this, this has no effect on the statutory warranty claims.
DELIVERY
Shipping costs (including VAT)
Domestic deliveries (Austria):
We charge a flat rate of 7.90 euros for shipping costs.
For orders over 90.00 euros, delivery is free of charge.
Deliveries within the EU:
We calculate the shipping costs abroad as follows:
Within Germany: 14.00 euros
For orders over 120.00 euros, delivery is free of charge.
Within the rest of the EU: on request
For orders over 150.00 euros, delivery is free of charge.
worldwide: on request
Deliveries to other EU countries:
Switzerland: Flat rate shipping fee: € 16.00
USA: Flat rate shipping fee: €32.00 or €89.00 for crib stables
Customs fees are to be borne by the customer.
Delivery times
Unless another deadline is specified in the respective offer, the delivery time is usually up to 14 days (if advance payment has been agreed after the time of the payment instruction) - due to the high level of craftsmanship or due to delivery delays on the part of the shipping service providers, which are not within the sphere of influence of Val Gardena Woodcarving Gebr. Grossrubatscher, delivery times may be longer.
Please note that there is no delivery on Sundays and public holidays.
If you have ordered items with different delivery times, we will send the goods in one shipment, unless we have made different agreements with you. In this case, the delivery time is determined by the item with the longest delivery time that you ordered.
AN ORDER
You can place orders online using a digital order form, by telephone or by email. When ordering via the order form, the goods intended to be purchased are named and selected with their item number, size and type. If there is a typo, the order can be corrected by re-submitting the form with a note in the comments field.
By sending the order by email, the customer submits a binding offer. The customer receives a confirmation email from us and the bank details for transferring the payment amount, provided the desired item is also in stock. If an item is not in stock and delivery is delayed, it will be agreed with the customer whether and when it can be delivered later.
RIGHT OF WITHDRAWAL
In the event of a withdrawal under the Long Distance and Away Transactions Act, the direct costs of returning the goods must be borne by the consumer. (According to Section 15, Paragraph 2 FAGG)
For individual orders and carvings that are made according to customer specifications or are clearly tailored to personal needs (e.g. through individual painting or engravings) or are hand-painted in response to the customer's order, the customer's right of withdrawal in accordance with Section 18, Paragraph (1 ) Point 3 FAGG.
